fa عملیات امدادرسانی بین المللی ارتش جمهوری اسلامی ایران در زلزله ترکیه در سال 1401 از منظر حقوق بین الملل تخصصي Special پژوهشي Research <div style="text-align: justify;"><span style="font-size:11pt"><span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><span sans-serif="" style="font-family:Arial,"><span lang="FA" style="font-size:14.0pt"><span style="line-height:115%"><span b="" mitra="" style="font-family:">کمک های بشردوستانه به آسیب دیدگان حوادث طبیعی از دغدغه های مهم جامعه بین المللی است. با توجه به مسئولیت دولت ها در حمایت از آسیب دیدگان بلایای طبیعی، انجام اقدامات امدادرسانی توسط سایر کشورها بنا بر اصول اساسی حقوق بین الملل یعنی اصل حاکمیت و اصل عدم مداخله و همکاری، منوط به درخواست و اجازه کشور آسیب دیده می باشد. زلزله سال 1401 ترکیه از بلایای طبیعی فاجعه آمیز قرن حاضر با خسارات مادی فراوان، بیش از پنجاه هزار کشته و بیش از صد هزار مجروح بر جای گذاشت. با درخواست کشور ترکیه و تصویب ستاد کل نیروهای مسلح، نیروی زمینی ارتش ج.ا.ا. با محوریت اداره بهداشت و درمان، با اعزام و استقرار یک بیمارستان سیار در مناطق زلزله زده با تجهیزات و نیروی انسانی کامل به مدت 15 روز به ارائه خدمات درمانی و امدادی پرداخت. این مقاله عملیات امدادرسانی مذکور را از منظر حقوق بین الملل بررسی نموده است. این عملیات، با رعایت اصول بنیادین حقوق بین الملل مطرح در منشور سازمان ملل یعنی اصل عدم مداخله و حق حاکمیت کشور ترکیه و با درخواست رسمی کشور ترکیه در راستای همکاری های اسلامی، منطقه ای و بین المللی انجام گردید و اقدامات درمانی با هماهنگی کامل با سازمان حوادث غیرمترقبه و وزارت بهداشت کشور ترکیه و منطبق بر قوانین این کشور با رعایت کرامت انسانی و حقوق اساسی بشری تمامی بیماران آسیب دیده از جمله شهروندان کشور ترکیه و نیز پناهندگان سوری که در مناطق زلزله زده حضور داشتند انجام گردید.</span></span></span></span></span></span></span></span></div> &nbsp; <div style="text-align: justify;"><span style="font-size:11pt"><span style="unicode-bidi:embed"><span style="line-height:115%"><span sans-serif="" style="font-family:Arial,"><span style="font-size:12.0pt"><span style="line-height:115%"><span new="" roman="" style="font-family:" times="">Humanitarian aid to victims of natural disasters is one of the major concerns of the international community. Given the responsibility of governments to support victims of natural disasters, relief efforts by other countries are subject to the request and permission of the affected country, based on the fundamental principles of international law, namely the principles of sovereignty and non-intervention and cooperation. The 2023 earthquake in T&uuml;rkiye, one of the most catastrophic natural disasters of this century, caused extensive damage, leaving more than fifty thousand dead and more than one hundred thousand injured. At the request of T&uuml;rkiye and with the approval of the General Staff of the Armed Forces, the Ground Forces of the I.R.I Army, With the main role of the Health and Treatment Department, deployed a mobile hospital in the earthquake-stricken areas with full equipment and manpower to provide medical and relief services for 15 days. This article examines this operation from the perspective of international law. This operation was carried out in compliance with the fundamental principles of international law set forth in the UN Charter, namely the principle of non-intervention and the sovereignty, and at the official request of T&uuml;rkiye in line with Islamic, regional and international cooperation.
